Petitioners are seeking regular bail in Katihar Town P.S. Case No. 697 of 2017 registered under Sections 341, 448, 323, 314, 504, 506, 379/34 of the Indian Penal Code. Learned counsel for the petitioners submits that both the petitioners' family and the informant's family are residing in the same house in two different flats and, as per the F.I.R., there was a fight amongst the two families in which the allegations have been made that these petitioners were also involved and had participated in assaulting and committing indecent behaviour which led to miscarriage of the six months pregnant wife of the
Patna High Court Cr.Misc. No.210 of 2018 (2) dt.12-01-2018 2/2 informant. Learned counsel further submits that these petitioners have no criminal antecedents and the whole occurrence, as it would appear from the F.I.R., is the result of the fight which took place between the two families on the spur of the moment in which wife of the informant was also participating. Considering the facts and circumstances, let the petitioners, named above, be released on bail on their furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 697 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
