2. The petitioner has prayed for anticipatory bail in a case registered for the offence punishable under sections 147, 341, 323, 354, 307, 379 of the Indian Penal Code.
3. Prosecution story relates to assault to the informant and his family members by the petitioner and other co-accused persons by means of lathi over a land dispute.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has been falsely implicated in this case. There is case and counter case between the parties. Both parties have received injuries in alleged occurrence. Petitioner was simply a member of the mob. General and omnibus allegations have been levelled against
Patna High Court CR. MISC. No.49283 of 2024(2) dt.12-07-2024 2/2 him. The alleged occurrence took place over a land dispute. Petitioner has no intention to commit the crime.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Impapur P.S. Case no. 71 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bhojpur at Ara subject to the conditions as laid down under section 438(2) of the Cr.P.C.
