2. The petitioner seeks bail in connection with Rajauli P.S. Case No. 494 of 2023 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, one loaded country made pistol along with one cartridge has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the similarly situated co-accused, Pawan Raza and Ram Ratan Chaudhari have been granted bail by this Court in Cr. Misc. No. 3438 of 2024 and Cr. Misc. No. 21004 of 2024 and the petitioner is in custody since 06.10.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the period of custody and the fact that the similarly situated accused persons have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Nawada in connection with Rajauli P.S. Case No. 494 of 2023, subject to the condition that:- (i) One of the bailors shall be a close blood relative of the petitioner.

(ii) The petitioner, after being released on bail is directed to mark his attendance at Atri Police Station on each Sunday of every month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
