12-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Rafiganj P.S. Case No. 138 of 2017 registered for the offence punishable under Sections 25(-B)a, 26, 35, 27 of the Arms Act.

It is submitted that there is an allegation of recovery of one loaded country made pistol with two live cartridges from the possession of the petitioner. However, submission is that the petitioner has no criminal antecedent and in fact nothing has been recovered from the conscious possession of the petitioner.

Learned counsel for the State opposes the prayer for bail of the petitioner.

Patna High Court Cr.Misc. No.297 of 2018 (2) dt.12-01-2018 Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Rafiganj P.S. Case No. 138 of 2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
