JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 12.04.2017 passed in Cr. Misc. No. 17789 of 2017 with direction to the Trial Court to conclude the trial within a period of four months and petitioner was given liberty that if the trial is not concluded with the said period, he may renew his prayer for bail.
Submission of learned counsel for the petitioner is that trial is pending at the stage of defence and has not been concluded uptil now and petitioner has been in custody since 02.01.2017 and is ready to abide by any condition imposed on him. Considering the above facts, I am not inclined to release the petitioner on bail rather the trial court is directed to conclude the trial within a period of six weeks even by conducting the trial on
Patna High Court Cr.Misc. No.1847 of 2018 (2) dt.17-01-2018 2/2 day to day basis.
Needless to say petitioner and other accused has to cooperate in disposal of trial so that the same be concluded within the period aforesaid.
