JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 2378 of 2017, disclosing offences under Sections 323, 498A, 394, 307 and 420 of IPC and Section 3⁄4 of Dowry Prohibition Act.

Petitioner happens to be the husband of the complainant. As per complaint case, there is allegation of demand and torture.

Submission of the learned counsel for the petitioner is that the whole allegations are false and concocted and he is still ready to keep her with dignity and care. Further a submission has also been made before the learned court below that he is still ready to keep her with dignity and care.

Patna High Court CR. MISC. No.42629 of 2019(6) dt.15-11-2019 2/2 Heard learned A.P.P. also.

It appears that earlier an ordinary notice was sent to the complainant and the office note as well as report disclosed that the ordinary notice has been received by the complainant but in spite of that, nobody appears on behalf of complainant. In such view of the matter, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Vaishali, at Hajipur, in connection with Complaint Case No. 2378 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that if the opposite party no.2 is ready to reside with the petitioner, he has to keep her with dignity and care.
