2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 393 of the Indian Penal Code.

3. It is alleged that four miscreants attempted to commit robbery with the informant. On chase, one of the miscreants was apprehended who disclosed the name of the petitioner as one of the miscreants who fled away.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has been made accused only on suspicion.

5. Considering the nature of accusation, this

No.44822 of 2023(3) dt.04-09-2023 2/2 anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Madhubani in connection with Kaluahi P. S. Case No. 52 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
