The petitioner seeks bail in a case registered for offences under Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 18 litres of foreign liquor kept in a container was recovered from a shop which is said to be owned by the petitioner but nothing has been recovered from the conscious possession of the petitioner. It is urged that the petitioner has remained in custody since 03.09.2017, i.e., for about more than two and
Patna High Court Cr.Misc. No.55660 of 2017(2) dt.23-11-2017 2/2 half months. It is claimed that the petitioner is having clean antecedent.
Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum-Special Judge, Excise, Begusarai in connection with Muffasil (Lakho) P.S. Case No. 404 of 2017 (G.R. No. 3150 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
