JUSTICE BIRENDRA KUMAR ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Buxar (M) P.S. Case No.254 of 2016, a case under Sections 147/341/323/307/504 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and co-accused Kamlesh is that they fired causing injury to Shyam Narayan Yadav, Prince Yadav and Arun Yadav. The injury report of Prince Yadav would reveal that the doctor has found a lacerated cut injury at the right side of the forehead besides swelling. Injured Arun Yadav sustained similar cut injury on the lower lateral part of the right thigh simple in nature and injured Shyam

Patna High Court Cr.Misc. No.58452 of 2017 (2) dt.14-12-2017 P2/ Narayan Yadav sustained lacerated cut injury at the left upper medial part of the chest and edema around above injury was simple caused by fire-arm. Petitioner is in custody since 01.07.2017.

Considering the nature of allegation and nature of injury, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Buxar (M) Police Station Case No. 254 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
