Heard counsel for the parties.
The aforesaid Interlocutory Application has been filed for withdrawal of the present appeal as the parties have settled the matter and have sanctioned the proposal of respondentslandlords for renewal of lease deed and payments of arrears vide
Patna High Court FA No.28 of 2014(17) dt.16-11-2022 2/2 letter BR/KAT/2019-20/02 dated 21.09.2019 which has been accepted by the plaintiff/respondents.
Annexure-A/1 dated 21.09.2019 as also para-2 of the petition read as follows:
"court cases to be withdrawn by both the parties" The learned Senior Counsel for the appellants submit that the aforesaid I.A. No.4 of 2019 be allowed for withdrawal of the present appeal.
In the facts and circumstance observed above, the I.A. No.04 of 2019 is allowed.
F.A. No.28 of 2014 In view of the fact that I.A. No.04 of 2019 stands allowed, the counsel for the appellants is allowed to withdraw the F.A. No.28 of 2014.
The same as such is dismissed as withdrawn.
