This application, for grant of anticipatory bail, arises out of Complaint Case No. 72 of 2018, in which cognizance has been taken under Sections 323 and 498A of the Indian Penal Code.
The allegation against the petitioners, who are fatherin-law and mother-in-law of Opposite Party No. 2, who was married with the son of the petitioners in the year 2004, is that the accused persons used to torture, mentally and physically, to the Opposite Party No. 2 because she has no fair complexion
Patna High Court CR. MISC. No.41613 of 2019(2) dt.05-07-2019 2/2 and always used to taunt her.
After having heard learned Counsel for the parties and taking into consideration that fact that the marriage between the son of the petitioners and the Opposite Party No. 2 solemnized in the year 2004 and petitioner s are father-in-law and motherin-law of the Opposite Party No. 2, aged about 61 and 59 years respectively, this application is allowed.
Let the petitioners, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gopalganj, in connection with Complaint Case No. 72 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
