Petitioners apprehend their arrest in a case filed under Sections 323, 307, 427, 435/120 of the Indian Penal Code and Sections 25 and 27 of the Arms Act.
It is contended on behalf of the petitioners that for the occurrence of same day, first information report was lodged by the petitioners' side being Avtar Nagar P.S. Case No.35 of 2016 and the present complaint case was filed, thereafter, only to save the skin and is an afterthought. Admittedly, there is land dispute
Patna High Court Cr.Misc. No.26385 of 2016 (2) dt.11-07-2016 2 / 2 between the parties.
Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Avtar Nagar P.S. case no.48 of 2016, the above named petitioners, Sekhar Chaudhary @ Shekhar Chaudhary @ Bekhar Chaudhary, Janki Chaudhary @ Janaki Chaudhary and Raj Ballabh Chaudhary @ Raj Ballam Chaudhary shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra, Saran subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
