2. The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 789/2021 registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.
3. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 06.12.2023 passed in Cr. Misc. No. 65950 of 2023.
4. As per the prosecution case, the petitioner who was already married had got married to the deceased three months before her death and it is alleged that he killed the deceased and hid her body in the agriculture field of one Kaushal Singh.
5. It has been submitted by the learned counsel for the petitioner is in jail since 30.08.2022 and he was working in
Patna High Court CR. MISC. No.49932 of 2024(3) dt.04-10-2024 2/2 Ludhiana and staying in Ludhian with his family. He further submits that he has been arrested from Ludhiana and because of some dispute, he has been falsely implicated in this case. The informant had not filed any case for second marriage of his daughter.
5. From the report of the trial court, it appears that only one witness has been examined though the petitioner is in jail for more than two years.
6. Considering the period of custody and the delay in trial this application is allowed.
7. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/ concerned court in connection with Hajipur Sadar P.S. Case No. 789/2021.
8. The petitioner will co-operate in the trial. He will appear personally or through his lawyer on the date fixed in the trial.
