2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8(c), 21(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. The case of the prosecution, in short, is that three persons were apprehended and were identified as Rupak Kumar Mehta, Kunal Krishna Kumar Roy (the petitioner) and Ahad.

4. Learned counsel for the petitioner submits that from perusal of the FIR itself it is clear that first of all Rupak was subjected to search and from his possession altogether 515 gm of smack was recovered and from possession of this petitioner nothing was recovered. Learned counsel for the petitioner has submitted that though all the three persons including the petitioner

Patna High Court CR. MISC. No.48979 of 2025(4) dt.09-01-2026 2/2 were on a bike but nothing has been recovered from the possession of this petitioner. Learned counsel for the petitioner has submitted that the petitioner is a man of clean antecedent and is in judicial custody since 17.03.2025.

5. Learned Additional Prosecutor for the State has vehemently opposed the bail application of the petitioner.

6. Earlier provisional bail was granted to this petitioner by the learned Co-ordinate Bench on medical grounds. The petitioner has filed documents showing his illness.

7. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail and the provisional bail granted earlier is confirmed. The above named petitioner is directed to be released on bail in connection with Mufassil P.S. Case No. 74 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (N.D.P.S. Act), Purnea.
