2. The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 307,379,504, 506/34 IPC registered in connection with Balrampur P.S. Case No. 44 of 2019.
3. It is submitted that the petitioners have been falsely implicated and there is case and counter case between the parties. Thrust of accusation of assault on the head of the informant is upon co-accused Dara Singh and on his leg by Haldhar Singh, the latter having been granted anticipatory bail by the learned Court below. The only accusation against the petitioners is having caught and hold the informant during the occurrence.
4. Learned APP assisted by learned counsel for the informant appearing suo motu opposes the anticipatory bail petition.
5. Having regard to the nature of accusations, gravity of offence alleged and considering the overt act of the petitioners facilitating assault which has resulted in grievous injury on the head of the
Patna High Court CR. MISC. No.41684 of 2019(2) dt.08-07-2019 2/2 informant, this Court is not inclined to grant the privilege of anticipatory bail to the petitioners. The anticipatory bail petition stands dismissed.
