JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioners apprehend their arrest in connection with Sikta P.S.Case No. 125 of 2017 registered for the offences under Sections 341, 323, 325, 379 and 308/34 of the Indian Penal Code. Allegation against the petitioner No.1 is of assault to informant's son on head by rod and allegation against other petitioners is of assault to the other son of informant. Submission of learned counsel for the petitioners is that the injury on the person of son of informant is simple in nature and there is general and omnibus allegation and there is case and counter case between the parties and the parties have compromised the case.

In the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, West Champaran, Bettiah, in connection with Sikta P.S. Case No. 125 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
