JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Phenhara P.S.Case No. 61 of 2015 registered under Sections 392/34 of the Indian penal Code.

Submission is that so-called looted motorcycle was not recovered from the possession of the petitioner and he has been implicated in this case only on the basis of disclosure of his name by a co-accused in his confessional statement. Having considered the aforesaid facts and circumstances, the petitioners, namely, Ranjay Singh @ Mukesh Singh and Amit Singh @ Amti Singh are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the

Patna High Court Cr.Misc. No.1446 of 2018 (3) dt.09-02-2018 2/2 like amount each to the satisfaction of the learned ACJM-XII, Motihari, East Champaran in connection with Phenhara P.S. Case No. 61 of 2015 with condition that one of the bailor must be their close family members. Petitioners shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, their bail bond shall be liable to be cancelled.
