HONOURABLE MR JUSTICE RAJIV ROY ORAL ORDER 15-09-2023 Heard Mr Ajay Mukherjee, learned counsel for the petitioner and Mr Raj Kishor Singh, learned APP. 2 The petitioner is in judicial custody in Panjawara PS Case No 79 of 2019 registered for the offence punishable under Sections 304B, 120B/34 of IPC and Sections 3⁄4 of Dowry Prohibition Act.

3 Earlier, prayer for bail of the petitioner was rejected by this Court by order dated 05.09.2022 passed in Cr Misc No 18117 of 2022 (Annexure 1).

4 As per the FIR, the informant has alleged that his daughter was married five years ago with the present petitioner but was tortured right since the marriage. On 19.07.2019, the informant came to know that his daughter has been assaulted by

5 Earlier, report was called for by this Court on 25.08.2023 which has since been received and as per the letter dated 31.08.2023 of the trial Court, three witnesses have been examined and the IO and the doctor are to be examined. 6 Mr Raj Kishor Singh, learned APP opposes the prayer for bail.

7 Taking into account the fact that the trial is at an advanced stage, for the present, this Court is not inclined to extend the privilege of bail to the petitioner. 8 This bail application stands rejected.
