The petitioner seeks bail in connection with Siwaipatti P.S. Case No. 132 of 2017 registered under Sections 272, 273/34 of the Indian Penal Code and 30(a), 38, 41, 48 of Bihar Prohibition and Excise Act.

17.265 lts. of foreign liquor is said to have been recovered from a car parked on the road located in front of the house of the petitioner and three persons sitting on the car managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has neither any

Patna High Court Cr.Misc. No.1669 of 2018 (3) dt.24-01-2018 2/2 concern with the aforesaid car nor with the seized liquor. No case under the Excise Act has been lodged against the petitioner earlier. The petitioner has been languishing in custody since 15.11.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. Sessions Judge cum Special Judge Excise, Muzaffarpur in connection with Siwaipatti P.S. Case No. 132 of 2017. (Prakash Chandra Jaiswal, J) rohit/- U T
