JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 This application, for grant of anticipatory bail, arises out of Mahila P.S. Case No. 02 of 2018, disclosing offences under Sections 498A of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.

Earlier vide order dated 11.04.2019, the case was referred to Patna High Court Mediation and Conciliation Center for settlement of dispute between the parties and learned Mediator has submitted the report, from which, it appears that the dispute between the parties has been resolved through the process of mediation on the terms of settlement mutually agreed upon by the parties, which is also part of the report, according to which, both the parties have decided to live separately and in lieu of that petitioner will pay Rs. Four Lakhs

Patna High Court CR. MISC. No.74266 of 2018(12) dt.16-05-2019 2/2 to opposite party no. 2 as one time settlement and the petitioner by bank draft No. 093414 issued by Indian Overseas Bank has already paid Rs. Four Lakh to opposite party no. 2 and on realisation of total amount of Rs. Four Lakh, the parties have agreed to withdraw their cases pending in the court below. In such view of the matter, this application is allowed and the provisional bail earlier granted to the petitioner vide order dated 01.02.2019 is confirmed subject to the condition that both the parties shall abide by the terms and condition as agreed between them.

Let a copy of Mediator's report as well as the copy of terms and condition agreed upon between the parties be sent to the concerned court below forthwith.
