Petitioner seeks bail in Ahiyapur P.S. Case No.142 of 2019 instituted for the offence under Section(s) 395, 412 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. No Test Identification Parade has been held. He has been arrested by the police merely on suspicion. It is further submitted that informant has alleged in the written report that miscreants were 18-20 years old, whereas, petitioner is aged about 50 years. Such statement has been made in para 9 of the bail application. Petitioner is in custody since 24.02.2019.

In the facts and circumstances of the case, prayer of

Patna High Court CR. MISC. No.41341 of 2019(2) dt.10-07-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No.142 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
