JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 341,323,324,326,504 and 379/34 of the Indian Penal Code. Counsel for the petitioner submits that the brother of the instant petitioner has lodged Paharpur P.S. Case No. 98 of 2014 in relation to an altercation which took place between the petitioner and the informant's side on 21.5.2014. Subsequent thereto the petitioner has been implicated in this case as a counter blast. He submits that even if the action of the 'Farsa' blow is taken but the report suggests that there is only one blow and there are no repeated injuries. Petitioner who is a man of clean antecedent is in jail custody since 31.08.2017. Investigation is completed and charge-sheet has been submitted in the instant case.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Paharpur P.S. Case No. 86 of 2014 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
