JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for informant. The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 600 of 2018 instituted for the offence under Section(s) 302/337/307/34 of the Indian Penal Code and Section 27 of the Arms Act.

In the written report there is specific allegation against this petitioner of causing firearm injury on the neck of the Baidyanath Rai from close range after putting the same on his neck on account of which he died.

Learned counsel for the informant has appeared and opposed the prayer for bail. He submits that postmortem report

Patna High Court Cr.Misc. No.75977 of 2018(3) dt.21-01-2019 2/2 fully supports the allegation as doctor has found firearm injury on the neck of the person of deceased. Copy of postmortem report has been produced by the learned counsel for informant during hearing of the appeal.

Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
