The petitioner seeks bail in Bhagwanpur P.S. case No.171 of 2014 registered under Sections 302, 120(B)/34 of the Indian Penal Code and Sections 27/25(1-b)a of the Arms Act, pending in the court of S.D.J.M., Bhabua.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is one of the assailants. This is the third attempt for grant of bail on behalf of the petitioner.

A report was called for from the trial court. It has been reported that all the prosecution witnesses have already been

Patna High Court CR. MISC. No.67743 of 2018(4) dt.17-04-2019 2/2 examined and the case is pending for statement of the accused under Section 313 of Cr.P.C. and the trial is expected to be concluded within a period of one month.

Considering the nature of allegations and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to conclude the trial at the earliest.
