Both the petitioners are named accused of Sheikhpura ( Hathiyawan O.P.) P.S. Case No. 49 of 2016 registered under Sections 341, 323, 307 and 504/34 of the IPC and Section 27 of the Arms Act.
In a highhanded manner, these two petitioners armed with pistol not only allegedly opened fire and put the gun on the temple of the husband of the informant but also thrashed the informant's mother-in- law.
Contention of the petitioners is that there is no allegation of causing any serious injury attributed to the
Patna High Court Cr.Misc. No.28082 of 2016 (3) dt.08-08-2016 2/2 petitioners. Both of them belonged to the one family. The dispute has been amicably resolved. An application has been filed in the Court.
Learned APP opposed the prayer and highlighted the manner in which the occurrence was committed. It appears that both the petitioners are accuseds in one other case of similar nature. The Court is not satisfied that a case for anticipatory bail is made out. It will be open to the petitioners to surrender and seek bail and place before the Court below all relevant facts including the petition said to have been filed on behalf of both the parties which shall be considered when such prayer is made and pass appropriate orders in accordance with law unprejudiced by the present order.
The bail application is dismissed.
