====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 409 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has antecedent of one case in which he is on bail and the informant alleges that petitioner was elected by Ward No. 13 of Gram Panchayat, Belaucha, P.S. Lakhnaur, DistrictMadhubani for supply of different materials under Nal-Jal Scheme and accordingly an amount of Rs. 6,50,000/- was given through Cheque dated 13.04.2018 which was received by the representatives of the petitioner, it is next alleged that neither

Patna High Court CR. MISC. No.49312 of 2022(2) dt.22-12-2022 2/3 the work was completed nor the relevant materials for which the payment was made, was supplied by the petitioner. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that from perusal of the Annexure-2 to the anticipatory bail application, it would manifest that on 18.04.2015 itself the Ward member of Ward No. 13 of the said Panchayat had purchased the goods from the shop of the petitioner for which receipts were issued, it is next submitted that the Panchayat Executive Committee owes an amount of Rs. 8348.34/- to the petitioner as the materials purchased from the shop of the petitioner was in excess of Rs. 6,50,000/-. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lakhnour P.S.
