The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365, 366A and 504/34 of the Indian Penal Code.
The prosecution case is of abducting the minor daughter of the informant.
In 164 Cr.P.C. statement the victim has got her age recorded as 21 years when the court also assessed as such where she has stated that she was never been abducted and wants to reside at her in-laws house. An application to that effect was also filed by the victim before the learned court below.
Patna High Court Cr.Misc. No.23799 of 2016 (2) dt.26-05-2016 2/2 It is submitted by learned counsel for the petitioner that the petitioner has performed marriage and the victim girl is major.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 49 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
