Petitioner seeks bail in connection with Nokha P.S. Case No. 299 of 2017 for offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 436, 427, 504, 153A, 295(A), 505(c) of the Indian Penal Code.
The prosecution case, as lodged by the police personnel, is that during Durga Pooja Visarjan two communities clashed with each other and ransacked the shops and also came before police station and resorted to brick-batting, as a result many police personnel and local people were injured. As many as 500700 people assembled and 92 including the petitioner is named in
Patna High Court Cr.Misc. No.55959 of 2017 (2) dt.27-11-2017 2/2 the F.I.R.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and that general and omnibus allegations have been levelled and there is no injury report in the case diary as such Section 307 I.P.C. is not applicable. It is further submitted that the petitioner is languishing in judicial custody since 03.10.2017 and that other co-accused has been granted the privilege of bail by this Court today itself in Cr. Misc. No. 55082 of 2017.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IVth Rohtas, Sasaram in connection with Nokha P.S. Case No. 299 of 2017.
