JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-01-2019 This application has been filed for modification of the order dated 14.12.2017 passed in Cr. Misc. No. 52193 of 2017 which stood allowed and disposed of by this Court. Learned counsel for the petitioner has confined his prayer to the extent that two months further time may be granted to pay the outstanding to the informant. Earlier, the anticipatory bail of this petitioner has been granted on the basis of undertaking given by the petitioner subject to the conditions that the petitioner will make payment of due amount of Rs. 10,20,000/- to the informant within period of one year from the date of order i.e. 14.12.2017 but in the light of non-compliance of the

Patna High Court Cr.Misc. No.67520 of 2018(5) dt.30-01-2019 2/2 order of this Court, learned A.C.J.M.-XIV Vaishali has rejected the prayer of the petitioner for extension of further time vide order dated 14.08.2018, which is at annexure-4 to this application.

In view of the above, this Court is of view that modification of order dated 14.12.2017 passed in Cr. Misc. No. 52193 of 2017 cannot be granted at this stage. Accordingly, this modification application stands dismissed. (Arvind Srivastava, J) brajesh/- U T
