The petitioners seek anticipatory bail in a case instituted for the offence under Sections 447, 341, 323, 324, 307, 379/34 of the Indian Penal Code.
It is alleged in the written report that Md. Rezanoor assaulted the informant with Dabia on the head of the informant causing cut injury and bleeding started. It is further alleged that when the informant fell down, Mir Ibrahim, petitioner No. 1 took away Rs.35,000/- from his pocket whereas petitioners No. 2 and 3 assaulted the informant with lathi.
Case diary has been received. The learned A.P.P. has
Patna High Court Cr.Misc. No.54671 of 2016 (3) dt.30-01-2017 2/2 pointed out about the injury report of the informant mentioned in paragraph-16 of the case diary wherein doctor has found three injuries on the person of the informant by hard and blunt object which is grievous in nature. As per the written report itself, there is specific allegation of causing injury against the petitioner No. 1 Rezanoor. There is general and omnibus allegation against the petitioners.
Considering the aforesaid facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Bousi P.S. Case No. 99 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Mithilesh Kumar, learned Sub Judge-VII-cum Additional Chief Judicial Magistrate-VI, Araria, subject to the conditions as laid down under Section 438 (2) Cr.
