2. Petitioner seeks regular bail in connection with Deo P.S. Case No. 93 of 2025 dated 06.04.2025 registered for the offences punishable under sections 126(2), 127(2), 115(2), 118(1), 109, 117(2), 190 and 191(2) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution story, the informant alleged that on 06.04.2025 around 7:30 A.M., he was called by Kamlesh Chaudhary (petitioner) for hiring his vehicle and when the informant along with one person, namely, Nitish Kumar reached at the spot, on the pretext of taking help, they were called inside the house of Kamlesh Chaudhary. Thereafter, they both were assaulted by FIR named person including 4 to 5 unknown persons. It is further alleged that Kamlesh Chaudhary (petitioner) cut the private part of Nitish Kumar.

The main submissions advanced by petitioner's counsel are that the allegation made against this petitioner is totally false, in fact the sister-in-law of this petitioner had been raped by the informant and others and in this regard, a police case bearing Deo P.S. Case No. 94 of 2025 was lodged (Annexure-3) and thereafter, in retaliation the petitioner has been falsely roped in the alleged occurrence. It is further submitted that during investigation, some independent persons have supported the alleged misbehaving with the sister-in-law of the petitioner by the informant and others. It is lastly submitted that the petitioner has been languishing in jail since 07.04.2025.
5. Learned APP for the State has opposed the prayer of the petitioner.

Considering the seriousness of the allegation appearing against this petitioner which relates to amputation of private part of one person, namely, Nitish Kumar by this petitioner which gets support from the medical report of said injured filed with this petition as Annexure- 2 series, this Court is not inclined to release the petitioner on bail in view of the nature of the said allegation.
