Petitioner along with others were apprehended by the police at wee hours while was engaged in preparing themselves to commit an offence, out of whom, five persons were apprehended while remaining managed to escape. On search, from the possession of petitioner, a countrymade loaded pistol was recovered along with other items. Petitioner has got criminal antecedent.
