This is an application for bail in connection with Nawada Town P.S.Case No. 589 of 2017 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 89 litres of liquor from the vehicle and petitioner is said to be driver of the said vehicle. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is driver and has nothing to do with the seized articles and he is in custody since 2.9.2017, having no criminal antecedent.

Having heard both sides and considering the facts and
Patna High Court Cr.Misc. No.55904 of 2017 (2) dt.22-11-2017 2/2 circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cum-Special Judge, Nawada, in connection with Nawada Town P.S.Case No. 589 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) If involvement of petitioner in such type of cases is found in future, his bail bond shall be cancelled.
