JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Dumraon P.S. Case No. 261 of 2018 for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner was engaged in ferry and his name surfaced in the instant case only on the clue received from the informer of the police. He further submits that the F.I.R. was lodged against two unknown miscreants. He further submits that there is absolutely no material against the petitioner to connect him in this case. The petitioner is in custody since 31.07.2018.

No.76566 of 2018(3) dt.29-01-2019 2/2 Considering the fact that the petitioner has got no criminal antecedent and there is no direct material to connect the petitioner in the instant case, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dumraon P.S.
