Ataur Rahman, learned Counsel, appearing on behalf of the petitioner, and Mr. Jai Shankar Barnwal, learned Government Advocate No.5, appearing on behalf of the Staterespondents. With the help of this writ petition, made under Article 226 of the Constitution of India, in the form of Public Interest Litigation, the petitioner has sought for directions to be issued to respondent No.6, namely, Bihar State Madarsa Education Board,
Patna High Court CWJC No.12233 of 2015 (2) dt.01-04-2016 2/2 not to act upon the inquiry report of District Education Officer, Katihar, vide letter No.107, dated 21.03.2014, and not to recommend to the State Government to give grant-in-aid to Madarsa No.1518, namely, Gaushia Wahidia Azharul Uloom Madarsa, Dakhin Tola Bhamraili, P.O. Soraiya, P.S. Dandkhora, Katihar.
The inquiry report shows that the distance between two existing Madarsas is five and half kilometers, which is much more than the minimum distance prescribed by the State Government.
It is submitted by the learned Counsel for the petitioner that the distance of the said Madarsa from another recognized Madarsa is barely one kilometer in the same village, but no supporting material has been furnished by the petitioner in this regard.
In view of the above, we do not find any reason to proceed with this application. This writ application is, therefore, closed.
