JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Balrampur P.S. Case No. 42 of 2020 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
The petitioner had earlier approached this Court for grant of regular bail, which was rejected by this Court by an order dated 26.06.2020 passed in Cr. Misc. No. 21001 of 2020. He has renewed his prayer for bail by making this application. The petitioner is in custody since 16.03.2020. Allegedly, the police had recovered 167.67 liters of Indian made
Patna High Court CR. MISC. No.4007 of 2021(2) dt.25-01-2021 2/2 foreign liquor from a Bolero vehicle, which was being driven by the petitioner.
Learned counsel appearing on behalf of the petitioner has submitted that a co-accused in similar circumstance has been allowed regular bail by this Court by an order dated 07.10.2020 passed in Cr. Misc. No. 22299 of 2020. Considering the submission that similarly circumstanced co-accused has been allowed regular bail by this Court, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Katihar in Balrampur P.S. Case No. 42 of 2020.
