In this writ application, made under Article 226 of the Constitution of India, in the form of a Public Interest Litigation, the grievances expressed by the petitioner is to the effect that the sole CD-4 machine at the ART Centre in Anugrah Narayan Magadh Memorial Hospital (ANMCH) is not operational for last 13 months due to non-appointment of a lab technician.

By filing a written counter affidavit, the respondents have shown that an operator for the said CD-4 machine has been appointed on contractual basis.

Patna High Court CWJC No.9674 of 2015 (2) dt.01-04-2016 2/2 In view of the above, while we close the writ petition, we direct the respondents to expedite the process of making permanent appointment in respect of operator of CD-4 Machine at ART Centre in Anugrah Narayan Magadh Memorial Hospital (ANMCH).

The petitioner shall be at liberty to approach this Court, with appropriate application, in future, if situation so warrants.
