2. The instant writ petition has been filed for the following reliefs:- (I). For issuance of an appropriate writ(s), order(s), direction(s) directing the Respondent Authorities to actively take decision on the series of representation preferred by the Petitioner for removing illegal encroachment and illegal construction which is being carried out upon the Petitioner's land bearing Khata No. 249, Khesra No. 345, Area 4 Decimal situated at Mauza- Janipur, P.S. Janipur, Patna despite pendency of the E-Mapi application of the Petitioner.

Patna High Court CWJC No.9023 of 2026(2) dt.02-07-2026 2/3 (ii) For issuance of an appropriate writ(s), order(s), direction(s) commanding the respondent authorities to forthwith take action on the E-Measurement Application No. 280052603175 dated 04/06/2026 submitted by the Petitioner for measurement of the plot bearing Khata No. 249, Khesra No. 345, Area 4 Decimal situated at MauzaJanipur, P.S. Janipur, Patna and till disposal of the E-Mapi application and the representations of the Petitioner, status quo may be granted on the land in question.

(iii) For issuance of an appropriate writ(s), order(s), direction(s) commanding the Respondent Authorities to protect the Petitioner's property from the anti-social elements and land grabbers.

(iv) For issuance of any other appropriate writ(s), order(s), direction(s) for which the writ petitioner would be found entitled under the facts and circumstances of the case.

Learned counsel for the petitioner submits that the petitioner has filed an application for measurement of land appertaining to khata No. 249, Khesra No. 345 at Mauza - Janipur, PS- Janipur, Patna. It has next been submitted that over which the jamabandi No. 285/1 has been running in his favour. and representation has already been placed before Additional District Magistrate, Patna for measurement of the plot in question, which is referred hereinabove and requisite deposit of fee has also been made, the receipt of which is appended with

4. On the other hand, learned counsel for the State submits that necessary directions may be issued to the concerned authorities to carry out necessary formalities for making measurement of the land in question in presence of the petitioner and other affected parties.

Considering the stand of the parties, this Court directs the Respondent No. 3 to carry out the measurement process of the land in question, for which requisite deposit of fee has already been made by this petitioner, by issuing notice to all concerned authorities including this petitioner by fixing a date and once the notices are served, measurement be made in their presence, so that the appropriate steps can be taken in order to get the issues redressed as provided in law. It is expected that the entire exercise shall be carried out within three weeks or as early as the representation is filed along with copy of this order and all supportive materials.
