JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-10-2018 It appears that the contempt application has been kept adjourning on the prayer of the learned counsel for the petitioner since last one year. It was lastly adjourned on 24.01.2018 granting two weeks time to learned counsel for the petitioner to file a substitution petition. No substitution petition has been filed despite a lapse of about nine months approximately.

On the other hand, a show cause served on learned counsel for the petitioner on 17.10.2017 is available on the record which shows that the petitioner has already received the residual/retiral-cum-death dues, details of which have been given in paragraph 8 of the show cause. There is no contest on that issue.

Patna High Court MJC No.2985 of 2014 (8) dt.11-10-2018 In the aforesaid view of the matter, this application cannot be kept pending allowing further adjournment to learned counsel for the petitioner in the name of filing of a substitution petition.

Learned counsel for the University is present. This application is dismissed in the aforesaid facts and circumstances.
