The present application has been filed for restoration of Cr.Misc. No.18296 of 2015 which stood dismissed for want of prosecution vide order dated 24.4.2015.

Learned counsel for the petitioners has submitted that the case was listed on 24.4.2015 but the same could not be marked as a result of which he could not attend the court when the case was called out and the case was dismissed due to non-prosecution.

Patna High Court Cr.Misc. No.28183 of 2016 (2) dt.20-07-2016 2/2 On the facts and in the circumstances of the case, the prayer is allowed.

The Registry is directed to restore Cr.Misc. No.18296 of 2015 to its original file.
