04-12-2017 Heard Sri Pritish Kumar Lal, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 12-10-2017 in Spl. Case No. 6926 of 2017, arising out of Patrakar Nagar P.S. Case No. 539 of 2017 registered for offence under Sections 30 (a), 30 (b), 38 and 41 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner's name in the present case has come only on confessional statement of co-accused before the police. He submits that save and except confessional statement, there is no other material to connect the petitioner in the present case. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph - 3 of the petition to show that
Patna High Court Cr.Misc. No.56611 of 2017(2) dt.04-12-2017 2/2 petitioner is having clean antecedent.
Considering the fact that petitioner's name has come in confessional statement of the co-accused, that too before the police as well as clean antecedent, let the petitioner namely Neeraj Kumar @ Raja be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna in connection with Spl. Case No. 6926 of 2017, arising out of Patrakar Nagar P.S. Case No. 539 of 2017. (Rakesh Kumar, J.) anay U T
