JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with N.D.P.S. P.S.Case No. 01 of 2017 arising out of Balia P.S. Case No. 19/2017 registered under Sections 8, 20(b) ii(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substance Act. Allegation in brief is that 110 Kg. Ganja in different packets was recovered from a Marshal vehicle found concealed in it. Learned counsel for the petitioner submits that petitioner is a driver and not the owner of the vehicle and he is in custody since 21.01.2017 and there is no recovery from his possession. Whereas learned counsel for the State submits that petitioner was driving the vehicle and huge commercial quantity of Ganja was recovered and it was being transported from Orissa to Khagaria.

Having considered the recovery of huge quantity of Ganja,

Patna High Court Cr.Misc. No.56304 of 2017 (6) dt.20-02-2018 2/2 the prayer for bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same preferably within a year.
