2. The petitioner is in custody in connection with Ismailpur P.S Case No. 117 of 2022 registered for the offences punishable under Sections 302, 120(B) 34 of the Indian Penal Code and 27 of the Arms Act.
3. As per allegation in the FIR, petitioner along with other co-accused has snatched the mobile phone of the brother of the informant and when he identified the accused persons namely Ankit Kumar and Sonu Kumar then Sonu Kumar opened fire upon the informant's brother due to which he died on spot.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.44210 of 2025(3) dt.03-09-2025 2/3 petitioner has falsely been implicated in this case. He next submits that nothing consistent material has come against the petitioner save and except so-called confessional statement of other co-accused person namely Sono Kumar @ Dilkush Kumar who has already granted bail by the co-ordinate Bench of this Court vide Cr. Misc. No. 53990 of 2023. Informant is also not the eye witness of the alleged occurrence. It is also submitted that petitioner is in judicial custody since 04.04.2025 having fourteen criminal antecedent. He further submits that other coaccused has been granted bail by the co-ordinate Bench of this Court vide Cr. Misc. No. 53990 of 2023 and 65746 of 2023
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, case diary and the impugned order dated 27.05.2025, it appears that during the course of investigation, no any direct or indirect evidence found against the petitioner. Moreover, the petitioner's name has been figured from the confessional statement of the co-accused namely Sonu Kumar who has already been granted bail by the co-ordinate Bench of this Court vide Cr. Misc. No. 53990 of 2023 and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the
Patna High Court CR. MISC. No.44210 of 2025(3) dt.03-09-2025 3/3 petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Naughachia in connection with Ismailpur P.S. Case No. 117 of 2022.
