JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. C/389 of 2017, disclosing offences under Sections 498A, 406 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act.
Petitioner happens to be husband of the complainant and allegation against him is of subjecting his wife to cruelty with respect to demand of dowry of Rs. 1,00,000/- . Submission of learned counsel for the petitioner is that as a matter of fact, complainant eloped with other person on 02.11.2017, for which a case was lodged by the petitioner being Gorasahan P.S. Case No. 558 of 2017 and only to save her skin, the complainant has lodged this false case.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahna, District - East Champaran, in connection with Complaint Case No. C/389 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
