The petitioner apprehends his arrest in Phenhara P.S. Case No.44 of 2020 registered under Sections 147, 149, 341, 323, 324, 504 and 506 of the Indian Penal Code. Later on, Section 307 of the I.P.C. was added.

Learned counsel for the petitioner submits that the petitioner has committed no offence and has falsely been implicated in the present case. The petitioner has no criminal antecedent.

Learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner and submitted that there is specific allegation of assault against this petitioner. Therefore, the petitioner does not deserve anticipatory bail.

Patna High Court CR. MISC. No.2683 of 2021(4) dt.25-11-2021 2/2 Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
