This is an application for bail in connection with Rajauli P.S.Case No. 240 of 2017 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act. Allegation as per FIR is that one Tata Sumo vehicle was intercepted and 780 litres of liquor were recovered from the vehicle and petitioner is said to be driver of the vehicle. Submission of learned counsel for the petitioner is that he is driver of the vehicle and he is working as per instruction of owner of vehicle. Further submission is he is in custody for three months, having no criminal antecedent.

Having heard both sides and considering the facts and
Patna High Court Cr.Misc. No.55898 of 2017 (2) dt.22-11-2017 2/2 circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cum-Special Judge, Nawada, in connection with Rajauli P.S.Case No. 240 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) If involvement of the petitioner in such type of cases is found in future, his bail bond shall be cancelled.
