1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 61, 3(5) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that his son on 14.08.2024 at 8.00 PM had gone for evening walk but did not return, thereafter on 15.08.2024 informant got an information from villagers that his son was killed and his dead body was hanged by a tree. Accordingly, the informant reached the place of occurrence and saw the dead body of his son hanging. Further alleges that wife and mother in-law of the deceased had threatened to kill his son. Patna High Court CR. MISC. No.46943 of 2025(4) dt.31-10-2025 2/3 alleged that based on suspicion that prior to the occurrence informant's co-villagers i.e. petitioner, Dharmendra Rai, Neeraj Kumar and Rohit Kumar had assaulted his son and had threatened to kill him.

4. The learned counsel for the petitioner submits that Dharmendra Rai along with Neeraj Kumar and Rohit Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.42233 of 2025 and the same was allowed by an order dated 09.07.2025. It is next submitted that the case of the petitioner is on a similar footing. It is submitted that petitioner is in custody since 19.04.2025 and charge-sheet has been submitted. It is further submitted that petitioner will not abscond rather will cooperate in the trial to prove his innocence.

5. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Bhagwanpur P. S. Case No.340 of 2024.

7. The application stands allowed.

However, it is made clear that if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the framing of charge or after framing of charge is trying to delay the trial in any manner the learned trial Court shall be at liberty to cancel the bail bonds of the petitioner (Satyavrat Verma, J) vikash/- U T
