JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Chhauradano P.S. Case No. 254 of 2017 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and sections 30(a) and 37(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 18.3 litres of illicit Nepali wine from the motorcycle of the petitioner herein. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. The petitioners have a clean antecedent and they are in custody since

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners are having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari in connection with Chhauradano P.S. Case No. 254 of 2017.
