The petitioner seeks bail in connection with Sour Bazar P.S. Case No. 487 of 2017 registered under Section 30(a) of Bihar Prohibition and Excise Act-2016.

39.00 lts. of illicit country made liquor is said to have been recovered from the motorcycle and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. As a matter of fact, while the petitioner was passing from the side of place of occurrence, he was apprehended and roped by the police merely on suspicion.

Patna High Court Cr.Misc. No.1624 of 2018 (2) dt.24-01-2018 2/2 No Excise Act has been lodged against the petitioner earlier. He has been languishing in custody since 24.10.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Saharsa in connection with Sour Bazar P.S. Case No. 487 of 2017.
