Petitioner seeks bail in Goh P.S. Case No. 105 of 2018 registered for the offence punishable under Sections 147, 148, 149, 385, 386 and120B of the Indian Penal Code, under Section 25(1-b), 9, 26 and 35 of the Arms Act and under Section 17 of the C.L.A. Act.
Allegation against petitioner is of recovery of Carbine, Medifire and 2 pieces of 0.315 bore live cartridges and other articles.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Nothing has been recovered from the possession of the petitioner. Petitioner is in custody since 19.05.2018.
Considering the fact that petitioner has criminal
Patna High Court Cr.Misc. No.77720 of 2018(3) dt.18-01-2019 2/2 antecedent and carbine has been recovered from his possession, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby rejected. However, it is observed that petitioner may renew his prayer for bail, after framing of charge.
